What Your Car Is Actually Worth After a San Antonio Crash, and How Texas Insurers Decide

Anyone who maintains their own vehicle has a number in their head for what it is worth. It is built from receipts, from the new timing belt, from the fact that the interior is clean and the service history is complete. An insurance adjuster arrives at a different number using a different method, and when the two disagree after a San Antonio crash, the method is what you end up arguing about.

Actual Cash Value Is a Market Number, Not a Receipt Total

Texas law defines actual cash value plainly. In the salvage and title provisions of Chapter 501 of the Transportation Code, actual cash value simply means the market value of the motor vehicle. That single sentence explains most settlement disputes. Market value asks what a comparable vehicle sells for, not what you have invested.

How the figure gets built

Carriers generally use a valuation vendor that assembles recent sale and listing data for similar vehicles within a search radius, then applies adjustments for mileage, trim, options and condition. The output is a report, and the report is a proposal rather than a verdict. Every line in it was a judgment call made by someone who never saw the car.

Why maintenance rarely moves the number

Routine upkeep is treated as the expected baseline for a vehicle in average condition, so a complete service binder often produces a smaller adjustment than owners anticipate. Documented work that genuinely changes condition, such as a recent set of tires, a new battery or a replaced transmission, is more likely to register than a decade of oil changes.

When Texas Treats the Car as a Total Loss

The threshold is stricter than the common shorthand suggests. Under the same chapter, a vehicle becomes a salvage motor vehicle when the cost of repairs, counting parts and labor but excluding both sales tax and the materials and labor for repainting, exceeds the actual cash value of the vehicle immediately before the damage. Repair cost has to clear the entire pre loss value, not some fraction of it.

The hail exception that surprises San Antonio owners

The statutory definition of damage expressly excludes sudden damage caused by hail, along with gradual damage from any cause and damage confined to the exterior paint. In a region that collects serious hail events, that carve out matters. A car can carry a repair estimate larger than its value and still not meet the statutory salvage definition if the cause was hail.

According to personal injury lawyer Nicholas R. Thompson, Principal and Managing Partner at RTRLAW, the most common mistake he sees in property damage disputes is treating the first valuation report as fixed when it is an opening position supported by data the owner is entitled to examine. Drivers who dispute a figure often work with a San Antonio car accident lawyer when the vehicle claim is tangled up with an injury claim, because the two are settled on different tracks and a signature on one can affect the other.

Where Valuations Commonly Go Wrong

The comparables are not really comparable

A valuation pulled from a wide radius can import vehicles from markets that price differently than Bexar County. Check the listed mileage, drivetrain and trim on each comparable. A single mismatched entry can drag an average down by a meaningful amount.

Condition gets flattened into a category

Vehicles are slotted into broad condition tiers. A well-kept car that lands in the middle tier by default is being valued as though it had ordinary wear. Photographs taken before the crash, inspection records and recent repair invoices are the practical way to argue for a better placement.

Aftermarket and factory options go missing

Options that were ordered from the factory, and permanent improvements made later, are frequently absent from the initial report because nobody entered them.

The Appraisal Clause Most Owners Never Use

Most Texas auto policies contain an appraisal provision for disputes about the amount of a loss rather than about coverage. The Texas Department of Insurance describes the mechanics in its auto insurance guide: each side hires an appraiser, the two appraisers select a third appraiser to act as umpire, and where the two estimates differ, the umpire decides. The umpire’s decision is binding on the amount.

It is a real remedy with real costs, since each side pays its own appraiser and shares the umpire. For a disputed figure of a few hundred dollars, it is rarely worth invoking. For a gap of several thousand on a late model vehicle, the arithmetic changes.

What to Assemble Before the Adjuster Decides

Photograph the odometer, the interior, the tires and every panel before the vehicle leaves your possession, because once it moves to a salvage yard the opportunity is gone. Request the valuation report itself rather than the summary figure. Pull your service records into one file. Note any recent purchases that are still on the car. Owners who can produce specifics tend to get adjustments; owners who argue that the number feels low generally do not.
